A few things:
The whipping in question looks worse on the head-on than it does in the pan video embedded in the Paulick Report article. When I watched the pan, I could not see the jock hit the (former) winner left-handed several times inside the eighth pole.
Like you, I'm not sure how to define abusive whipping, but counting strikes seems the most straightforward. With a national rule that has already been in place for almost three months and at least a couple of previous DQ's that have been covered in the racing press, no one can complain that they didn't understand the rule.
Admittedly, it does sound extreme that one or two extra strikes can result in a DQ, but then again, that's one or two strikes after that jock has already hit the horse three times above the limit of six.
What I do like is enforcing the rules via purse redistribution rather than affecting the parimutuel payoffs. I'd like to see more of that (especially where a winner is DQ'd for costing another horse 2d or 3d place money). The owners and trainers have the greatest opportunity to improve the way things are done in the game, and purse redistributions can give them a strong incentive to do so.
